Coaching is a relationship which is designed based on the group coaching program Participants’ expressed interests, business objectives and challenges.  

TRG will be using program materials, questions, requests and discussions to help Participant identify business and personal goals, challenges, strategies and action-plans, and monitors progress towards implementation of the action plans.

Participant agrees and acknowledges that TRG’s services are advisory and Participant bears sole responsibility for the use of these services by Participant.  TRG is neither a guarantor nor an insurer of any outcome from the coaching processes. Participant is responsible for his or her own efforts, achievements, failures and success. TRG cannot and will not promise that Participant will take any specific action or attain specific goals or other outcomes.  Participant agrees to forever indemnify and hold harmless TRG employees or contractors of TRG’s organization from and against any loss or damage (including reasonable attorney fees, expenses and court costs) resulting from Participant’s activities related to the subject matter herein.  Participant agrees that this indemnification clause survives termination of this Agreement.

Confidentiality – Participant acknowledges that in the course of TRG’s delivery of its services TRG may ask Participant questions, which may be challenging, personal or outside of Participant’s area of comfort. Participant understands and agrees these questions are important to the coaching process and fully understands that TRG will keep all these deliberations confidential.

TRG acknowledges they may obtain confidential business or personal information from Participant and agrees to keep and maintain such information confidential and not to disclose or use such information to others without Participant’s prior written consent. During a group coaching session or follow-up activities, Participant may receive private or confidential information disclosed by another member of the coaching group or TRG. Participant agrees to not reveal, pass along or use that information without the express written consent of the party who made the disclosure. 

Participant agrees to not record or video tape any of the sessions.  Sessions may be recorded by TRG and Participant may have access to recorded sessions.  Participant agrees that any and all program content, including but limited to recordings, presentations, written text, worksheets and any and all other materials provided by TRG, are confidential and proprietary to TRG and TRG’s company and may not be re-engineered or shared, disclosed, released not to any third party whatsoever.

The group coaching program is a month-to-month basis until canceled by Participant at any time upon 30 day’s prior written notice.  There is no refund for any group program tuition already paid.  There will be a $25 fee for any month in which Participant’s credit card payment does not process successfully for any reason.  Participant shall have 3 business days to provide a new, valid source of payment to TRG.

Neither TRG nor Participant shall be responsible nor shall be held liable for any failure to comply with any of these Terms and Conditions when that failure is caused directly or indirectly by earthquake, hurricane, fire, strike union or other labor problems, declared or undeclared wars, riots, insurrection, government restrictions or other acts or other causes beyond the control of or without the fault of TRG or Participant.
